Ok. So a wrecker at my apartment complex (attempted) to tow my Miata away because it had an expired tag on it this morning (having just got it out of the shop last week and putting it back in today, I haven't had it updated)
He demanded $50.00 on the spot not to tow it away.
I talked him out of the whole thing.
So, is it legal for them to do that? Where would I confirm that?

im sure it is in your rental contract somewhere. where i used to live i couldnt even change the oil or else that was grounds for contract termination.

pissing me off. tried towing it a second time. in one day. they even told me last saturday that they wouldn't tow my car because of the expired tag when I asked at the office.

get that in writing. Also, make sure that you put A COPY on the cars Dashboard.
If they just backed up, and is getting ready to hook the car... then you still have the upper hand in the situation.
Once your car is hooked, and the car is in the air... its their car.

take your tag off while its parked. and cover the vin or something. if its on your property then idk what else they can do.
also, find out who is making the guy come out to tow it. if its someone at the office then you know what to do.

Ok, sorry this is a post from another forum where I posted the whole thing in more detail. So yea. But it describes the whole thing in more depth and I'm too lazy right now to retype it.
And if I took the tag off they would tow it too. They made that clear.
....ok, so I got my miata back from being turbocharged (finally) and still have to fix the water pump (which is making it overheat)
I had to park in a handicap spot in front of my apartment because one of the neighbors was throwing a party and had every possible parking spot full already. Left it there overnight - got a warning ticket the next morning for parking in a handicap spot / expired tag (my car had been in the shop still when it ran out)
So I went down to the office, the girl said to just move the car and to ignore the expired tag thing, that they wouldn't tow it for the tag, just for being in the handicap spot. That was last saturday.
So this morning, they tried towing my car. I went out and told the tow truck guy everything, that I had JUST gotten it back last Friday after having been in the shop for a year and a half, and that I was supposed to be taking it to my mechanic today to finish doing the last repairs before getting the tag fixed. He said that he wouldn't tow the car if I gave him $50.00, I was like 'screw you'. He was like 'you're breaking a florida statute having an expired tag' (which is a lie, I looked it up) Finally, he said just make sure I get rid of it and fix it today.
So I went over and woke up my mechanic (who lives a few buildings down from me) and we were waiting on his buddy to show up so we could take the car to the shop when the tow guy shows up again and starts trying to tow the car again. He told us the front office called us, yelling at him that 'they had moved the car to building 14, go tow it!' And he left.
So we went to the front office to complain about the whole thing - the tow guy was sitting there. So one of the girls and the manager comes out and starts yelling at us about the car. That we had 'blocked the guy from taking the car' that 'we were interfearing with their business' (the apartment complex) that 'they had told me friday that I had until wednesday to get my expired tag fixed' (which they had directly told me the opposit, that the expired tag was NOT an issue, just the handicapped spot) etc. etc. etc.
So we're all pissed off. They're threatening to kick us out of the apartment, etc. And I'm a good neighbor, I've never had any problems with anyone. And it's a nice apartment complex, we don't live in some ghetto place. (we pay like $1,500.00 a month, lol. sucks.) So we took the car over across the street and parked it in the target parking lot until we can get it towed to my buddies shop. (the water pump is out, we can only drive it a mile or so before it overheats and redlines)
I'm soooooo pissed off. Like my buddy said, there were 4 other cars sitting there next to mine, 3 with expired tags and another without a tag. And none of them were even warned. Someone must have it out for me, and I can't figure out who, because I've never done anything to anyone around here. Don't even know anyone but my mechanic and one neighbor who plays airsoft with us.

I would take pictures of the cars that have expired tags, and I would take it to the office. I would turn this into a huge racial argument, and belive me this is something that the property manager would fear more than sitting in a cell with 5 two hundred pound niggas with gold teeth. :lol:
But before all that I would have gotten it in writing that I had untill wednesday.
Also, it is in all the apartment complexes contracts say that vehicles with expired tags are not allowed.
Towing a vehicle with expired tags is allowed on public property, thats after a warning though, and in private properties, its at the owner/agents discretion.
and parking in a handicap spot is an obvious.
